Terms of Service

These Terms govern your use of Hagglefy, an online marketplace operated by Hagglefy Inc. (“Hagglefy”, “we”, “us”) that connects private sellers of used vehicles with private buyers in Canada. By creating an account, listing a vehicle, or using the platform, you agree to these Terms. Please also read our Privacy Policy, Fees & Refunds, and Acceptable Use pages, which form part of these Terms.

1.What Hagglefy is, and is not

Hagglefy is a listings, search, and communications platform. Every sale is a private transaction between two individuals: a seller and a buyer. Hagglefy is not a party to that sale, is not a motor vehicle dealer, and never takes ownership, possession, custody, or control of any vehicle.

Hagglefy does not broker, negotiate on your behalf, inspect, transport, finance, insure, or warranty any vehicle. We do not guarantee the condition, legality, history, title, or fitness of any vehicle, nor the identity, conduct, or solvency of any user beyond the verification steps described below.

2.Eligibility and account verification

You must be the age of majority in your province and legally able to enter contracts. Sellers must complete government-ID identity verification through our third-party provider before a listing goes live. Verification confirms identity only; it is not an endorsement or a guarantee of any user's honesty or the accuracy of their listing.

You are responsible for the security of your account and for all activity under it. Provide accurate information and keep it current.

3.Listings and seller responsibilities

Sellers are solely responsible for the accuracy and legality of their listings, including the vehicle's description, condition, mileage, history, and their legal right to sell it. You must own the vehicle or be authorized to sell it, and it must be free of undisclosed liens unless disclosed.

You must comply with all applicable laws, including provincial motor-vehicle, consumer-protection, and safety-standards requirements for private sales. Curbsiding, selling vehicles as a business while posing as a private seller, is prohibited and may be unlawful.

4.Anonymous negotiation and identity reveal

During negotiation, buyers and sellers communicate through aliases; contact details are hidden. Our systems filter messages to keep contact information masked until identities are revealed. Attempting to circumvent this masking to move a transaction off-platform in order to avoid the fee is a breach of these Terms.

When both parties agree on a price, identities and contact details are revealed so the parties can complete the sale directly and privately. Hagglefy is not involved in the exchange of the vehicle or the vehicle purchase funds.

5.The seller fee

Hagglefy's only charge is a flat seller fee, by vehicle price band, charged to the seller when a deal is agreed and identities are revealed. The fee is for Hagglefy's service of connecting the seller with a verified, committed buyer. It is not a commission on, or a percentage of, the vehicle price, and the vehicle purchase price never passes through Hagglefy. 6.Payments are processed by Stripe

Seller fees are processed by our third-party payment processor, Stripe. By providing payment details you agree to Stripe's terms. Hagglefy does not store full card numbers. [COUNSEL: confirm Stripe Connect terms coverage for the flat seller-charge structure and chargeback liability allocation.]

7.Disclaimers and limitation of liability

The platform is provided “as is” and “as available.” To the fullest extent permitted by law, Hagglefy disclaims all warranties and is not liable for the acts or omissions of any user, the condition or legality of any vehicle, any dispute between buyer and seller, or any indirect, incidental, or consequential damages. Where liability cannot be excluded, it is limited to the fees you paid to Hagglefy in the twelve months before the claim. 8.Indemnity, suspension, and termination

You agree to indemnify Hagglefy against claims arising from your listings, your transactions, or your breach of these Terms. We may suspend or terminate accounts that violate these Terms, the Acceptable Use page, or applicable law.

9.Governing law and changes

These Terms are governed by the laws of the Province of Ontario and the applicable laws of Canada. [COUNSEL: confirm governing-law/venue choice for a Canada-wide rollout, and any mandatory consumer-protection carve-outs by province, including Quebec.]

We may update these Terms; material changes will be posted with a new “last updated” date. Continued use after changes means you accept them.
